General Data Protection Regulation
The General Data Protection Regulation (EU) 2016/679 (GDPR) took effect on 25 May 2018. The GDPR is now incorporated in the legislation of each EU member state. On some issues local legislation may derive from the GDPR and some additional local legislation may require further protective measures or have additional rights and freedoms the persons. The goal of GDPR is to guarantee your privacy and provide protection from unwanted and unlawful infringement of your personal data worldwide.

Cookies at our website

Origin of personal data

Eurocept Pharmaceuticals collects personal data direct from you when you choose to use our products and services, call or email us or directly give us information in other ways. Your personal data may be provided to us through a professional health care provider, like your Doctor or Pharmacist.

If your personal data, or part thereof, is not required for our processing orders for our products or services, this data will not be collected, or records received are anonymized.

Eurocept Pharmaceuticals websites do not have the intention of collecting data on visitors below the age of 16 years unless they have permission from a parent or guardian. However, Eurocept Pharmaceuticals does not maintain an age check on the websites. We therefore advise parents to monitor their children’s online activities, in order to prevent data being collected about children without parental consent. If you are convinced that we have collected personal data about a minor without such consent, contact our Data Protection Officer.

Personal data collected

At Eurocept Pharmaceuticals we may collect and process the following personal data, if and when required in processing orders and or complaints:

  • Initials
  • Gender
  • Date of Birth or age

  • Email address
  • Signature (on digital copies of forms only)
  • Medical data
  • Social security number (if required for reports or insurance claims)
  • Other data provided by yourself during telephone contact or in any correspondence

For commercial purposes Eurocept Pharmaceuticals may also collect following data on business contacts:

  • Profession or job title
  • Business email address
  • Business telephone number
  • Place of business
  • Dates and content of business contacts, like telephone meeting or visit
  • Consent to contact
  • Other data provided by business contacts

Purpose of processing

Eurocept Pharmaceuticals processes personal data for purposes of:

  • Offering our products and services at the request of your health care provider;
  • To contact you, if required for rendering our products or services;
  • To answer your questions or complaints on our products or services;
  • To provide information to health insurers to support financial claims;
  • To report adverse events to authorities;
  • To fulfil legal obligations interred upon Eurocept Pharmaceutical by Government or Courts.

Lawfulness of processing

All processing of personal data by Eurocept Pharmaceuticals is done lawfully and fair. Processing of personal data is done only if one of the following applies:

  • the person involved has given consent to the processing by Eurocept Pharmaceuticals;
  • processing is necessary for the performance of a contract between a person and Eurocept Pharmaceuticals;
  • processing is necessary for the compliance of a legal obligation of Eurocept Pharmaceuticals;
  • processing is necessary in the vital interest of person involved;
  • processing is necessary for the purposes of the legitimate interests of Eurocept Pharmaceuticals.

Processing of special categories of personal data, like medical data, will only be done if one of the following applies:

  • the person involved has given explicit consent to the processing by Eurocept Pharmaceuticals;
  • processing is necessary for the compliance of a legal obligation of Eurocept Pharmaceuticals;
  • processing is necessary in the vital interest of person involved;
  • processing is necessary for reasons of public interest in the area of public health.

Transfer to third parties

Eurocept Pharmaceuticals will not sell personal data to third parties and will only provide this data if it is necessary, within the scope of the concluded service provision contract, for rendering the service provision to you or to comply with a legal obligation. Where applicable, Eurocept Pharmaceuticals has a Processing Agreement with companies that process personal data in order to guarantee the same level of security and confidentiality. Eurocept Pharmaceuticals remains responsible for these processing activities.

International transfer of personal data

Eurocept Pharmaceuticals will not transfer personal data to organizations or Governments beyond the European Economic Area, unless:

  • transfer is necessary for reasons of public interest in the area of public health and all data is anonymized and for receiver not traceable to an identifiable natural person;
  • the person involved has given explicit consent to the transfer by Eurocept Pharmaceuticals and Eurocept Pharmaceuticals ensured prior to transfer that rights and freedoms derived from GDPR are maintained by receiver.

Access to personal data at Eurocept Pharmaceuticals

Eurocept Pharmaceuticals provide only those employees access to personal data as required by them to perform their daily duties. Those functions with access to personal data are included in the Processing Register. Our Data Protection Officer can provide further information from the Processing Register.

Automated decision-making

Eurocept Pharmaceuticals does not use automated processing or decision-making involving personal data or for matters that can have (significant) consequences for people.

Retention period

Eurocept Pharmaceuticals retains and stores personal data for the duration necessary for achieving its objectives, unless a longer retention period is required or permitted by law. Retention periods are included in the Processing Register. Our Data Protection Officer can provide further information from the Processing Register.

Security measures for data protection

Eurocept Pharmaceuticals takes the protection of your data seriously and takes suitable technical and organizational measures to prevent misuse, loss or unauthorized access, unwanted disclosure and unauthorized modification. Security measures are included in the Processing Register. Our Data Protection Officer can provide further information from the Processing Register.

If you believe that personal data are not properly secured or there are indications of misuse, contact our Data Protection Officer.

Your rights

If Eurocept Pharmaceuticals is processing personal data based on the, explicit, consent of a person, this person has the right to revoke the consent at any moment in a comparable manner as consent was given.

You have the right to:

  • have access to the processing of personal data;
  • rectification of personal data;
  • erasure of personal data;
  • restriction of processing;
  • data portability;
  • object to processing.

These rights may be restricted due measures or provisions as laid down in GDPR and local legislation.

Data Protection Officer

Eurocept Pharmaceuticals has appointed a Data Protection Officer (DPO). The DPO monitors our compliance with GDPR. For any questions or queries on processing personal data at Eurocept Pharmaceuticals you may contact the DPO at the above-mentioned addresses. Eurocept Pharmaceuticals wishes to point out that you have the possibility of lodging a complaint at the DPO. Such complaint will be managed within 30 days after receipt. Any contact with the DPO is confidential.
